With reference to your confidential despatch of

the 19th of December last, I have the honour to enclose the
draft Contract for the scheme for the development of a portion
of the south side of the island of Hongkong, and the plan
referred to in Articles 1, 12, 27, 29A, 30 and 31. The plan is
only provisional as the route of the tramway and consequently
the adjoining land can only be ascertained by survey as provid-
ed in Clause 1. You will observe that the clauses are not
numbered consecutively. This is due to the fact that some have
been omitted and two inserted namely 27A and 29A, but it was
considered advisable to keep the original numbering for the
present to avoid confusion when dealing with the minutes and
correspondence in the file.

The draft was submitted to the Legislative
Council on Thursday, 25th of June, when Mr. Landale drew atten-
tion to the provisions of Articles 23 and 24 whereby the sole
right of supplying electricity and gas was granted to the pro-
moters for a period of 25 years. I enclose a copy of the Articles in their original form and the proceedings in Council. I postponed the consideration of the draft agreement and care- fully considered the point raised as it appeared that neither

the Hongkong Electric Co. nor the Hongkong Gas Co. possesses any monopoly within the areas they supply, the clauses were amended
